The Biden Administration is considering an executive order to restrict asylum access by using the exact same law previously weaponized to ban people from Muslim-majority and African countries from entering the U.S.

The Justice Department’s Office of Legal Counsel is reportedly making sure that the proposed executive order could withstand litigation — knowing that district and appellate courts found the previous administration’s use of Section 212(f) authority to be unconstitutional.

If President Biden follows through with this executive order, our country will be turning its back on our longstanding commitment to providing asylum protections to families and people who arrive on U.S. soil.

We still have the chance to influence a change of course. Just as we raised our voices in 2017, we must once again urge the White House to end all consideration of discriminatory asylum bans in the U.S. immediately.
